Politics: David Mark's Election Annulled by Appeal Court

The immediate past Senate President, Senator David Mark has received a shocker as his election which was before now upheld by the election tribunal has now been annulled by the appeal court. In the court’s judgement, INEC was ordered to conduct rerun of the elections within 90 days.

Daniel Onjeh of the APC had earlier contested Senator David Mark’s win at the March polls. Onjeh however lost at the election tribunal forcing him to appeal. The tribunal led by Justice Mosunmola Dipeolu had ruled that the evidence brought before it were documentary hearsay evidence.

The appellate court however, held that Senator David Mark failed to fully meet the requirements of certain sections of the electoral act, namely sections 73 and 74 and certain paragraphs of the INEC approved electoral guidelines.

In his judgement reading, Justice Peter Ige said  “the lower tribunal cannot be seen to blow hot and cold at the same time. The appellant has established his case on the balance of probability. It is our considered view that the appellant’s appeal is meritorious.

“The appellant showed by oral evidence that collation of results was still ongoing a day after the declaration of results of the election in seven local government areas of the district.

“The judgement of Justice Mosunmola Dipeolu led tribunal of October 7th., 2015 dismissing the petition is nullified. Therefore the election of Senator David Mark is hereby set aside.

“INEC is by this judgement to conduct fresh senatorial election in the Benue South district within 90 days.”

The PDP and Senator David Mark have yet to fully respond to this judgement as at the time of this publication.
