Politics: Akwa Ibom Election Tribunal - APC Candidates Run Into Problems

The Gubernatorial candidate of the APC in Akwa Ibom and his Deputy may have run into problems at the election tribunal holding in the state. The PDP are seeking to throw out their petition based on a provision in the constitution which renders their candidature invalid.

This clog in the wheel of the APC petition is as a result of  the provision of the 1999 constitution, Section 182 (1) g) which reads “No person shall be qualified for election to the office of a governor of a state if still employed in the public service of the federation or any state.”

According to investigations carried out by the Akwa Ibom Consolidated Political Action Committee (AIPAC), it was revealed that the Deputy Gubernatorial aspirant Mr. Benedict Effiong Ukpong  was in the employ of  Federal Capital Development Agency (FCDA) till June 2015. This was proven by the fact that he had been receiving his monthly salary till June 2015. The said salary was paid into a First Bank account.

To further complicate issues for the APC, the group cited another provision of the constitution which tied the fate of the Gubernatorial aspirant to that of his Deputy. Section 187 (1) of the 1999 Constitution that provides that: “In any election to which the foregoing provisions of this part of this chapter relate, candidate for the office of governor of a state shall not be deemed to have been validly nominated for such office unless he nominates another candidate as his associate for his running for the office of governor, who is to occupy the office of deputy governor.”

Further more, Section 187 (2) of the 1999 Constitution further stipulates that, “The provisions of this part of this chapter relating to qualification for election, tenure of the office, disqualifications, declaration of assets and liabilities and the oath of governor shall apply in relation to the office of deputy governor as if references to governor were references to deputy governor. Therefore, whatever disqualifies a deputy governorship candidate equally affects the governorship candidate.

The group finally cited a precedence that should guide the decision of the court. In a case in 2007 between the Attorney General of the Federation (AGF) v Abubakar (2007) in paragraphs 174-175 G-C, Justice Pius Olayiwola Aderemi JSC, maintained that the position of the law is clearly stated and reiterated to wit that, “a governor and his deputy governor shall swim and or sink together for the purposes of an election so that whatever fate befalls the governor automatically applies to the deputy governor.

With these submissions, the PDP is confident that the candidature of Mr. Umana O. Umana and his deputy, Mr. Benedict Effiong Ukpong, – Gubernatorial and Deputy Gubernatorial aspirants for the APC – will be invalidated by the court. It is also thought that this will be a litmus test to the sincerity of President Buhari to abide by the provisions of the constitution and rule of law.

That is typical of public sectors in Nigeria. Even if you tender resignation, it can take them one year to remove you from payroll. Its left for you to ensure the money is returned immediately or later. If he can prove he did tender his resignation letter before the election then, no course for alarm.
