Asset declaration - Lawyer sues Buhari and Osinbajo

President Buhari is in the news again as this time he and his vice Osinbajo are being sued by a Lawyer for not having declared their assets. Kabir Akingbolu who is both a Lawyer and a rights activists has taken the the two top citizens to a Lagos Federal High Court for what he termed their failure to fulfill their promise of declaring their assets publicly to Nigerians.

In his suit, Akingbolu claimed that the President and his Vice went against Section 172 and Section 11 (1) and (2) of the Code of Conduct for public officers under the Fifth Schedule to the 1999 Constitution (as amended) when they decided to declare their assets secretly. Joined in the suit as co-defendants are Attorney General of the Federation and the Code of Conduct Bureau.

Mr Akingbolu listed his prayers to the court as follows:

  • That the court declare that it was mandatory for the CCB to publicly publish the assets of Buhari and Osinbajo.
  • That the court declare that the secret declaration of assets by Buhari and Osinbajo was unconstitutional.
  • That the court mandate them to publicly declare their assets in line with the Code of Conduct for public officers under the Fifth Schedule to the Constitution.

To support his motion, Mr Akingbolu presented an affidavit in which testified that President Buhari and Professor Osinbajo during their campaigns, promised to publicly declare their assets. He also stated that the President and his Vice as public servants, were bound under the code of conducts to declare their assets publicly.

It will be recalled that President Buhari during the campaigns, widely promised to declare his assets publicly. He not only did this, he also promised that anyone who will work with him must also do likewise. Its been over two months since he took over and no such thing has occurred. He has however, declared his assets secretly thereby raising concerns about the extent of his sincerity and ability to fight corruption as so wide claimed.
