Abia State: Appeal Court Overturns Tribunal's Judgement, Declares Alex Otti Winner

APGA’s Alex Otti has been declared the rightful winner of the Abia state 2015 Gubernatorial elections. This judgement overturns the ruling of the election tribunal which had upheld the election of PDP’s Okezie Ikpeazu.

The five man panel headed by Justice Omoleye stated that APGA’s Alex Otti scored 164, 444 valid votes  as against the 114, 444 valid votes scored by PDP’s Okezie Ikpeazu. The court thereby declared Alex Otti winner of the April elections and supplementary elections.

In the Appeal court’s judgement, Justice Omoleye said   the cancellation of elections in Obingwa, Osisioma Ngwa and Isiala Ngwa local government council by the returning officer was illegal. According to the Justice, “In the Electoral Act, the Returning Officer has the right to only declare results of elections and not to cancel elections.

“This panel discovered that the earlier results uploaded to INEC headquarters correspond with the correct valid registered voters in the three LGAs, while that awarded to the respondent shows over voting and therefore null and void.’’

The court has directed INEC to present Alex Otti with the certificate of return and immediately swear him in as the Governor of Abia State.
